2. TENNESSEE EXPUNGEMENT LAW EXPLAINED
What Is Expungement?
Expungement is a legal process that erases your criminal record as if the arrest
or charge never happened. After expungement:
- ✅ Your record is destroyed (except for limited law enforcement access)
- ✅ You can legally say you were never arrested or charged on job applications
- ✅ Background checks will NOT show the expunged record
- ✅ Housing, employment, and licensing applications will not show the record
Tennessee Expungement Law (T.C.A. § 40-32-101)
Who Can Expunge?
- Arrests without charges: If you were arrested but no charges were filed,
you can petition for expungement 2 years after the arrest.
- Dismissed charges: If charges were filed but dismissed (nolle prosequi),
you can petition immediately.
- Not guilty verdicts: If you were tried and found NOT GUILTY, you can
petition immediately.
- Misdemeanor convictions: If convicted of a misdemeanor, you can petition
5 years after completing your sentence (including probation, fines,
and restitution).
- Felony convictions: If convicted of a non-violent felony, you can petition
5 years after completing your sentence IF:
- You have no new convictions, AND
- The District Attorney General does not object
- DAG diversions: If you completed a District Attorney General's
pre-trial diversion program, you can petition immediately with the
DAG's consent.
The Expungement Process
Timeline: 60-90 days typical (longer if objection filed)
Steps:

- Clerk serves notice on District Attorney General, arresting agency,
Tennessee Bureau of Investigation (TBI), and Federal Bureau of
