2. TENNESSEE EXPUNGEMENT LAW EXPLAINED

What Is Expungement?

Expungement is a legal process that erases your criminal record as if the arrest

or charge never happened. After expungement:

  • ✅ Your record is destroyed (except for limited law enforcement access)
  • ✅ You can legally say you were never arrested or charged on job applications
  • ✅ Background checks will NOT show the expunged record
  • ✅ Housing, employment, and licensing applications will not show the record

Tennessee Expungement Law (T.C.A. § 40-32-101)

Who Can Expunge?

  1. Arrests without charges: If you were arrested but no charges were filed,

you can petition for expungement 2 years after the arrest.

  1. Dismissed charges: If charges were filed but dismissed (nolle prosequi),

you can petition immediately.

  1. Not guilty verdicts: If you were tried and found NOT GUILTY, you can

petition immediately.

  1. Misdemeanor convictions: If convicted of a misdemeanor, you can petition

5 years after completing your sentence (including probation, fines,

and restitution).

  1. Felony convictions: If convicted of a non-violent felony, you can petition

5 years after completing your sentence IF:

  • You have no new convictions, AND
  • The District Attorney General does not object
  1. DAG diversions: If you completed a District Attorney General's

pre-trial diversion program, you can petition immediately with the

DAG's consent.

The Expungement Process

Timeline: 60-90 days typical (longer if objection filed)

Steps:

  1. File Petition for Expungement with criminal court clerk
  2. Clerk serves notice on District Attorney General, arresting agency,

Tennessee Bureau of Investigation (TBI), and Federal Bureau of

Investigation (FBI)

  1. Agencies have 30 days to object

Step 1: Get Your Criminal History Record

Why: You need to know exactly what's on your record before you can expunge it.

  1. Go to: https://www.tn.gov/tbi/
  2. Download "Request for Criminal History Record" form
  3. Have your fingerprints taken at local police station or TBI office
  4. Mail form + fingerprints + $29 fee to:

Option 2: Court Clerk Records Request

  1. Go to the criminal court clerk's office where your case was

Option 3: Public Background Check

  1. Use Tennessee's public background check: https://tbireports.tbi.tn.gov/

  3. Results are immediate
