IV. ELIGIBILITY UNDER 18 Pa.C.S. § 9122

Petitioner is eligible for expungement because:

4.1 ☐ Nonconviction Data: Petitioner was not convicted of the charged offense(s). The disposition was:

4.2 ☐ 18-Month Rule: No disposition was received within 18 months after the date of arrest, no disposition is available, and no action is pending. Pursuant to 18 Pa.C.S. § 9122(a)(1): "no disposition has been received or, upon request for criminal history record information, no disposition has been recorded in the repository within 18 months after the date of arrest and the court of proper jurisdiction certifies to the director of the repository that no disposition is available and no action is pending."

4.3 ☐ Acquittal: Petitioner was acquitted of all charges following a trial and verdict of not guilty. Pursuant to 18 Pa.C.S. § 9122(a)(4): "a judicial determination has been made that a person is acquitted of an offense, if the person has been acquitted of all charges based on the same conduct or arising from the same criminal episode following a trial and a verdict of not guilty."

4.4 ☐ Unconditional Pardon: Petitioner received an unconditional pardon for the offense. Pursuant to 18 Pa.C.S. § 9122(a)(2.1): "a person has been granted an unconditional pardon for an offense in accordance with law."

4.5 ☐ ARD Completion: Petitioner successfully completed the Accelerated Rehabilitative Disposition program. Pursuant to 18 Pa.C.S. § 9122(b): expungement shall occur "where the defendant has successfully completed the conditions of any pretrial or post-trial diversion or probation program."


V. ELIGIBILITY UNDER 18 Pa.C.S. § 9123 (JUVENILE RECORDS)

5.1 Petitioner was under 18 years of age at the time of the offense.

5.2 The juvenile proceeding resulted in:

5.3 Pursuant to 18 Pa.C.S. § 9123(a): "expungement of records of juvenile delinquency cases and cases involving summary offenses committed while the individual was under 18 years of age, wherever kept or retained, shall occur after 30 days' notice to the district attorney whenever the court upon its own motion or upon the motion of a child or the parents or guardian finds" the conditions set forth above.

5.4 Petitioner has NOT been convicted of a felony or misdemeanor, or adjudicated delinquent, since the final discharge from supervision, and no proceeding is pending seeking such conviction or adjudication.
