1. ELIGIBILITY CHECKER — CAN YOU FILE FOR DIVORCE IN PENNSYLVANIA?

3. Fault-Based Divorce (23 Pa.C.S. § 3301(a))

The Divorce Process in Pennsylvania

Step 1: File Complaint (Day 0)

Property Division in Pennsylvania

Pennsylvania is an "equitable distribution" state, NOT a "community property" state.

What this means:

  • Court divides property FAIRLY (not necessarily 50/50)

Pennsylvania uses the "best interests of the child" standard.

Types of Custody:

1. Legal Custody — Decision-making authority
