STATUTORY NOTICE TO THIRD PARTIES

- A certification that this Power of Attorney has not been revoked
- An English translation of this Power of Attorney if it is not in English

FILING INSTRUCTIONS
Execution Requirements (N.Y. General Obligations Law §§ 5-1501B, 5-1513)
A New York Power of Attorney must be:
- In writing and signed by the principal (or by another person at the principal's direction and in the principal's presence)
- Acknowledged by the principal before a notary public or other authorized officer
- Signed by the agent (recommended but not strictly required for validity)
Optional but Recommended:
- Two witnesses (helps prevent challenges to validity)
- Statutory Gifts Rider if agent may make gifts (required for gifts to agent or over $500/year)
Recording:
- If this Power of Attorney will be used for real estate transactions, record it in the county clerk's office where the property is located
- Recording is optional but recommended for real estate matters
Copies:
- Make copies for your agent, successor agents, and financial institutions
- Keep the original in a safe place (safe deposit box, attorney's office, or home safe)
- Banks may require their own Power of Attorney forms in addition to this document
Revocation:
- To revoke this Power of Attorney, execute a written revocation and provide copies to your agent and any institutions that have accepted the original
- You may revoke at any time while you are competent
- Send a copy of the revocation to all parties who may have relied on the Power of Attorney
