1. Eligibility Checker — Who Can Change Their Name in New Jersey

You ARE eligible if:

  • You are a resident of New Jersey
  • You are at least 18 years old (minors need parent/guardian to petition)
  • You are not changing your name to defraud creditors
  • You are not changing your name to avoid criminal prosecution
  • You are not changing your name for other fraudulent purposes

Special Requirements for Minors

If changing a minor child's name:

  • Both parents must typically consent, OR
  • If parents disagree, the court applies the best interest of the child standard (see Gubernat v. Deremer, 140 N.J. 120 (1995))
  • Factors include: child's preference, length of time using the name, potential anxiety or embarrassment, and parental consent

Criminal History

If you have been convicted of a crime:

  • You must disclose all criminal convictions in your complaint
  • The court will notify the Division of Criminal Justice or county prosecutor
  • The court may still grant the name change if there is no fraudulent purpose

Victims of Domestic Violence

If you are changing your name due to domestic violence:

  • You may request that publication requirements be waived
  • See In re E.F.G., 398 N.J. Super. 539 (App. Div. 2008)

Complaint Requirements (N.J.S.A. 2A:52-1; Rule 4:72-1)

Your verified complaint must include:

  1. Your current full legal name
  2. The name you want to change to
  3. Your date of birth
  4. Statement that you are not seeking the change to avoid creditors or criminal prosecution
  5. Disclosure of any criminal convictions
  6. Disclosure of any pending criminal charges
  7. If a minor: whether any family action is pending or concluded within the past 3 years

3. Step-by-Step Filing Instructions

Step 1: Complete Your Verified Complaint

  1. Draft your complaint including all required elements (see sample language below)
  2. Include your current name, requested new name, date of birth, and reasons
  3. State clearly that you are a New Jersey resident
  4. Disclose any criminal history honestly

Step 2: Get Your Complaint Notarized

  1. Take your unsigned complaint to a notary public
  2. Bring valid government-issued photo ID
  3. Sign the complaint in front of the notary
  4. The notary will notarize your signature (verification)

Where to find a notary:

  • Banks and credit unions (often free for customers)
  • UPS Store or FedEx Office ($5–$15)
  • Town clerk's office
  • Public libraries (some offer free notary services)

Step 3: Make Copies

Make 4 copies of your completed, notarized complaint:

  • Original for the court
  • Copy for your records
  • Copy for the judge
  • Extra copies for service and publication

Step 4: File with the Superior Court Clerk

  1. Go to the Superior Court, Chancery Division in your county
  2. Bring your original complaint and copies
  3. Pay the filing fee ($175–$250 depending on county)
  4. The clerk will stamp your documents and assign a docket number
  5. Ask about the return date (hearing date) process

Step 5: Publish Notice (Rule 4:72-3)

In most cases, you must publish a notice of your name change application:

  1. The notice must appear in a newspaper circulating in your county
  2. Publication typically runs once, at least 2 weeks before the return date
  3. The newspaper will provide an Affidavit of Publication
  4. File this affidavit with the court before your hearing

Exceptions to publication:

  • Victims of domestic violence (request waiver)
  • Safety concerns (explain in confidential filing)

Step 6: Attend Your Hearing (If Required)

  1. Dress appropriately (business casual)
  2. Arrive 15–30 minutes early
  3. Bring your copy of the filed complaint
  4. Bring government-issued photo ID
  5. Bring the Affidavit of Publication (if applicable)
  6. The judge may ask why you want to change your name
  7. Answer truthfully and briefly

Step 7: Get Certified Copies of the Judgment

  1. After the judge signs your Final Judgment, get at least 3 certified copies
  2. You will need these to update your:
  • Social Security card
  • Driver's license
  • Birth certificate
  • Bank accounts
  • Other official records

Step 8: File Judgment with County and State (Rule 4:72-4)

After the judgment is signed:

  1. File a certified copy with your County Clerk
  2. File a certified copy with the NJ Department of Treasury (for state records)

After the Judge Signs Your Judgment

Update your Social Security record first:

  1. Complete Form SS-5 (available at ssa.gov)
  2. Bring certified court order, current ID, and completed form
  3. Visit your local Social Security office
  4. Receive new Social Security card in 7–14 days

Then update your New Jersey Driver's License:

  1. Bring certified court order and new Social Security card
  2. Visit a NJ MVC agency
  3. Pay the duplicate license fee ($11)
  4. Receive new license same day
