What This Document Does
This is an Answer to a Complaint for Possession (eviction) filed by your landlord in New Jersey Superior Court, Special Civil Part. Filing this Answer tells the court you are contesting the eviction and presenting legal defenses. It prevents a default judgment and preserves your right to stay in your home.
When to Use This
Use this document if:
- Your landlord filed a Complaint for Possession against you in New Jersey
- You want to contest the eviction and present defenses
- You believe your landlord failed to maintain the property, violated your rights, or lacks good cause to evict
- You need time to prepare your case before the hearing
New Jersey's Strong Tenant Protections
New Jersey has some of the strongest tenant protections in the country under the Anti-Eviction Act, N.J.S.A. 2A:18-61.1 et seq.:
- Your landlord CANNOT evict you without good cause
- You can only be evicted for specific reasons listed in the law
- Even if you don't have a written lease, you have tenant rights
- Rent-stabilized tenants have additional protections
Before You File
Gather these items:
- [ ] The Complaint for Possession you received (shows your hearing date)
- [ ] Your lease or rental agreement (any version you have)
- [ ] All rent payment records (receipts, bank statements, money orders)
- [ ] Any written notices you sent to your landlord
- [ ] Any notices you received from your landlord
- [ ] Photos of problems with the property
- [ ] Photo ID
- [ ] $50–$100 for filing fee (see fee waiver below)
Step-by-Step Filing
- Fill out the Answer form completely. Replace all bracketed text with your real information.
- Choose your defenses. You do not need to use every defense. Only check the ones that apply:
- No Good Cause: Landlord hasn't proven a legal reason for eviction
- Habitability: Landlord failed to maintain safe, livable conditions
- Improper Notice: Landlord didn't give proper notice before filing
- Rent Acceptance Waiver: Landlord accepted rent after knowing about the alleged violation
- Retaliation: Landlord is evicting you for exercising your rights
- Make 3 copies. Keep one for yourself.
- Go to the Special Civil Part, Landlord/Tenant Division. See court addresses below.
- File with the clerk. Pay the filing fee ($50–$100).
- Fee Waiver: If you cannot afford the fee, ask the clerk for an IFP (In Forma Pauperis) application.
- The clerk will stamp your copy. Keep this copy safe.
- Serve the landlord. Mail a copy of your Answer to the landlord (or their attorney). Fill out the Certificate of Service at the bottom of the Answer.
- Attend the hearing. Your hearing date is on the Complaint. DO NOT MISS THIS DATE.
At Your Hearing
Bring:
- Your stamped copy of the filed Answer
- The original Complaint for Possession
- All supporting documents (lease, receipts, notices, photos)
- Any witnesses who can testify about conditions or conversations
Arrive 30 minutes early. Dress neatly.
When your case is called:
- "Your Honor, I am [YOUR NAME], the defendant. I filed an Answer on [DATE]."
- "I am contesting this eviction because [state your main defense]."
- Present your documents when asked.
- "Under N.J.S.A. 2A:18-61.3, my landlord must prove good cause for eviction, which they have not done."
What Happens Next
- If you win: The eviction is dismissed. You can stay in your home.
- If you lose: The court will enter a judgment for possession. You typically have 3 business days to move before a warrant of removal can be issued.
- Three-Day Payment Period (N.J.S.A. 2A:42-10.16a): Even after a warrant is posted for non-payment of rent, you have 3 business days to pay all rent due. The landlord MUST accept payment and the court MUST dismiss the case with prejudice.
- If you want to appeal: You have 10 days to file an appeal. You must pay rent into court during the appeal.
Retaliation Protection (Archive-Verified)
Under N.J.S.A. 2A:42-10.12, a rebuttable presumption of retaliation exists if your landlord serves a notice to quit or changes your tenancy terms after you:
- Complain to a government authority about health or safety violations
- Try to enforce your rights under the lease or NJ law
- Join or organize a tenant organization
This means the court will assume retaliation unless the landlord proves otherwise.
