QUIT CLAIM DEED RESERVING LIFE ESTATE

The Grantor (owner) transfers the property NOW but keeps the right to live in and use the property for the rest of their life. The Grantee (beneficiary) receives full ownership only upon the Grantor's death. This structure can protect against Medicaid estate recovery.

RESERVATION OF LIFE ESTATE

GRANTOR HEREBY RESERVES unto Grantor, and Grantor's heirs and assigns, a life estate in and to the above-described property. During the term of this life estate, Grantor shall have the exclusive right to:

  1. Occupy and possess the property and reside therein;
  2. Use, enjoy, and benefit from the property as if Grantor were the sole owner;
  3. Receive all rents and profits arising from the property;
  4. Make improvements to the property at Grantor's expense;
  5. Pay all property taxes, insurance, and maintenance costs associated with the property.

Grantor shall NOT have the right to:

  1. Sell, mortgage, or otherwise encumber the remainder interest without Grantee's written consent;
  2. Commit waste that would materially diminish the value of the property to the remainderman.

Upon the death of Grantor, the life estate shall terminate automatically and full fee simple title shall vest immediately in Grantee (or Grantee's heirs if Grantee predeceases Grantor) without the need for probate.
