title: "Mississippi Quit Claim Deed Reserving Life Estate"
state: "MS"
date: "2026-04-07"
authority: "Miss. Code § 89-1-1 et seq."
QUIT CLAIM DEED RESERVING LIFE ESTATE
State of Mississippi
The Grantor (owner) transfers the property NOW but keeps the right to live in and use the property for the rest of their life. The Grantee (beneficiary) receives full ownership only upon the Grantor's death. This structure can protect against Medicaid estate recovery.
> MEDICAID NOTICE: A life estate deed may protect property from Medicaid estate recovery because the life estate interest terminates at death and the remainder passes outside the probate estate. Consult a Mississippi elder law attorney before executing if Medicaid planning is your primary goal. Rules change frequently and individual circumstances vary.
